These Terms & Conditions (“Terms”) govern all purchases and subscriptions made on our website hosted on the Wix platform.

These Terms apply to all online sales and subscriptions offered on this website, including:

By ordering or subscribing, the customer acknowledges having read and accepted these Terms.
3. Orders and Availability
All artworks and prints are offered within the limits of available stock or artistic editions.
Because each piece is created or produced in limited quantities, availability may vary.
In the event of unavailability after an order, the customer will be informed promptly and refunded in full.
4. Prices
All prices are listed in euros (€), excluding any applicable taxes (if relevant) and shipping costs, which are displayed before final confirmation.
For international orders, customs duties or import taxes may apply and remain the responsibility of the buyer.
GooL reserves the right to modify prices at any time, but orders will always be billed based on the prices displayed at the time of purchase.
5. Payment
Payments are processed securely through Stripe and PayPal, integrated via Wix.
The customer agrees to provide accurate billing information.
Card details are handled exclusively by the payment processors and are never stored by GooL.
An order is considered confirmed only after successful payment.
6. Shipping and Delivery
Print Club Subscriptions:
Print Club envelopes are packaged and shipped manually by GooL each month.
Shipments are sent via standard postal mail from France. Estimated delivery times vary depending on destination and postal services.
Artworks and Fine Art Prints
Other artworks (originals, fine art prints, sculptures) are shipped through La Poste or equivalent international carriers with tracking whenever possible.
Shipping fees and delivery times are indicated during checkout.
GooL cannot be held responsible for delays or damage caused by postal services once the package has been handed over to the carrier.
7. Right of Withdrawal and Returns
Standard Products (prints, originals, sculptures)
Customers have a 14-day withdrawal period starting from the date of delivery, in accordance with Articles L221-18 et seq. of the French Consumer Code.

Returned items must be in perfect condition and in their original packaging.
Return shipping costs are borne by the customer unless the product is defective or incorrect.
Refunds will be processed within 14 days after receiving and inspecting the returned product.
Exceptions : Print Club and Custom Works
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to:

personalized or custom-made items,
-
artworks created to order or in limited edition,
-
periodic or subscription-based deliveries of artistic creations.
Therefore, Print Club subscriptions, as well as unique artworks and commissioned pieces, are not eligible for cancellation or refund once the order or subscription has begun.
8. Damaged or Lost Shipments
If your package arrives damaged or is lost in transit, please contact GooL within 7 days of delivery (or expected delivery date) at art.goo10@gmail.com.
Each case will be reviewed individually, and replacements or partial refunds may be offered depending on availability and circumstances.
9. Intellectual Property
All artworks, prints, texts, designs, and images on this site are the exclusive property of GooL.
No part of the website or artwork may be reproduced, copied, or used for commercial purposes without written permission.
10. Privacy and Data Protection
Personal data collected during purchases, subscriptions, or account creation are processed in compliance with the General Data Protection Regulation (GDPR).

11. Governing Law and Dispute Resolution
These Terms are governed by French law.

These Terms & Conditions of Sale (hereinafter reffered to as "Terms") govern all sales made through this website.
Please read them carefully before placing any order. By confirming a purchase, the buyer acknowledges having read, understood and accepted these Terms in full.
1. Seller identification
The seller's legal identity, registration number, and contact details are provided in the Legal Notice section of this webiste.
2. Products/ Works offered
All artworks, limited editions, and collectibles offered on this website are described and photographed with the greatest care.
However, as some pieces are handmade or printed in limited numbers, slight variations in color, texture, or appearence may occur.
These differences shall not be concidered defects.
3. Prices
All prices are listed in euros and include applicable VAT where relevant, in accordance with the seller's tax status as both Artiste-Auteur and Auto-Entrepreneur under French law.
Prices do include shipping costs within France.
For deliveries outside France, shipping costs will be calculated and added at checkout, before the customer confirms the order.
The seller reserves the righ to modify prices at any time, but the buyer always will be charged the rate displayed at the time of purchase.
4. Orders & Payment
Orders are confirmed once the payment is successfully processed.
Accepted payment methods are those displayed at checkout (such as credit card, PayPal, or other secure options.)
The seller reserves the right to cancel any order in the event of non-payment, suspicion of fraud, or abnormal activity.

6. Returns & Rights of Withdrawal

Any reproduction, modification, or distribution without authorization is strictly prohibited.
8. Loyability
The seller cannot be held respondible for indirect damages, such as loss of income or opportunity, resulting from the use of artworks or delays in delivery.

In accordance with Article L612-1 of French Consumer Code, the consumer may contact the relevant consumer mediator for free in order to settle any dispute amicably.

TERMS AND CONDITIONS OF SALE

MIND GEMS PRINT CLUB
Please note that all Mind Gems Print Club shipments are prepared and sent directly by GooL from her studio in France. Envelopes are stamped and sent without tracking, to keep shipping simple, careful, and affordable.
These Terms and Conditions of Sale (T&Cs) govern subscriptions to the Mind Gems Print Club offered by GooL, visual artist and sole trader, on www.hallofgool.com.
Any subscription implies full acceptance of these conditions.
1. Purpose
The Mind Gems Print Club is a monthly subscription allowing members to receive one signed art print and a personal letter from the artist. Each piece is created, packaged, and shipped by GooL to the address provided at the time of subscription.
2. Price and Payment
The subscription costs €7 (tax included) per month. Delivery is included for France; additional fees may apply for international shipping. Payment is made by card or PayPal and automatically charged each month on the date of subscription.
3. Duration and Cancellation
The subscription is monthly and automatically renewed.
Subscribers may cancel at any time before the next billing date by emailing art.gool10@gmail.com or via their account.
Any month already started remains due; no partial refund or cancellation is possible once the print has been prepared or shipped.
4. Shipping
Prints are shipped at the end of each month by standard mail, without tracking.
From the date of shipping confirmation, average delivery times are estimated as 3–5 business days for France, 4–10 for Europe, and 7–30 for international destinations.
GooL cannot be held responsible for delays, losses, or postal errors once the shipment has been posted. In the event of an incorrect address, reshipping costs will be borne by the client.
If an item appears lost after three weeks, the client may contact GooL to discuss a suitable solution (reprint, later shipment, or goodwill gesture).
5. Right of Withdrawal
According to Article L221-28 of the French Consumer Code, the right of withdrawal does not apply to personalized artworks. Since each print is specially created for club members, no cancellation or refund is possible once payment has been confirmed.
6. Damages
If a print arrives damaged, the client has 14 days to contact GooL with photos as proof. A replacement or other commercial gesture may be offered depending on the case. No return is accepted without prior agreement.
7. Personal Data
The information collected is used solely for managing and delivering subscriptions. Data is processed in accordance with the site’s Privacy Policy.

8. Applicable Law and Disputes
These Terms and Conditions are governed by French law.

Commission & Licensing Terms

Custom Artwork & Album Covers
1. Definitions
-
“Artwork” refers to any original work of visual art (painting, illustration, mixed media, sculpture) created by the Artist.
-
“Commission” means the agreement between the Artist and the Client for the creation of an Artwork tailored to the Client’s brief.
-
“Album Cover Project” refers to a Commission where the Artwork is intended for use as cover art for a music release or similar commercial use in the music industry.
-
“Client” means the individual or entity commissioning the Artwork.
-
“Usage Rights” refers to the rights of reproduction, representation, distribution, adaptation and any exploitation of the Artwork.
2. Copyright and Moral Rights
2.1 Under Articles L111‑1, L121‑1 and following of the Code of the Propriété Intellectuelle, the Artist holds moral rights which are perpetual, inalienable and imprescriptible.
2.2 The physical sale or delivery of an Artwork does not, by itself, transfer the Artist’s economic/property rights (droits patrimoniaux).
2.3 The Client recognises that the Artist remains the author of the Artwork and retains moral rights including the right of attribution and integrity.
3. Scope of the Commission and Usage Rights
3.1 For a Personal Commission (non‐commercial use):

The Client receives the physical Artwork, for personal display only.
-
No reproduction or commercial licence is included unless expressly agreed.
3.2 For an Album Cover Project: -
The Client receives the physical Artwork and a licence to use it for the specific purpose agreed (album cover, digital release, promotional use) as set out in the quote.

The licence may be exclusive or non‑exclusive, limited to certain territories, formats, duration or media, all specified in the quote.
3.3 Any additional usage (merchandise, posters, prints for sale, adverts, NFTs, adaptation) outside the agreed project requires a separate licence and fee, which will be specified in the quote.
4. Quote, Pricing and Payment Terms
4.1 The Artist will provide a personalised quote based on size, medium, complexity, materials, intended use, and other factors.
4.2 A deposit equal to 50% of the highest price range quoted is required upon acceptance of the quote before work begins.
4.3 The balance is due before delivery/shipment of the Artwork.
4.4 The final price may be slightly higher or lower than stated, depending on final brief, materials, production time and usage agreed.
5. Delivery, Shipping & Ownership of the Physical Artwork
5.1 Ownership of the physical Artwork passes to the Client upon full payment.
5.2 Shipping costs, insurance, and any customs duties (for international delivery) are the responsibility of the Client.
5.3 The Artist is not liable for loss or damage once the Artwork is handed to the carrier; the Client should inspect and report any visible damage within 7 days.
6. Revisions, Cancellation & Refunds
6.1 The quote will include expected timeline and number of revision rounds. Major changes may incur additional fees.
6.2 Once work has commenced (after deposit) or when the Artwork is created to order, the Client cannot withdraw under the 14‑day withdrawal right. Commissioned works, customised artworks and Album Cover Projects are non‑refundable. Ministère de la Culture
6.3 If the Artist cannot fulfil the Commission, the deposit will be refunded in full.
7. Resale Right (“Droit de Suite”)
The Artist retains the resale right for original graphic and plastic artworks in line with French law (Article L122‑8 CPI).
8. Governing Law & Dispute Resolution
8.1 These Terms are governed by French law.
8.2 Any dispute shall first attempt amicable resolution. For consumers residing in France or the EU, they may refer to the CM2C mediation body at 14 rue Saint‑Jean, 75017 Paris.
8.3 Failing mediation, the dispute will be submitted to the competent French courts.
9. Client Acknowledgement
By paying the deposit or proceeding with the Commission, the Client acknowledges having read, understood and accepted these terms in full.
Shipping & Returns Policy

This Shipping & Returns Policy explains how orders, deliveries, and returns are handled for purchases made on the GooL website (operated via the Wix platform).
1. Shipping and Processing Times
Each order is carefully prepared and packed by the artist.
Processing times vary depending on the product type:

Shipping costs are automatically calculated at checkout based on destination, package weight, and delivery method.

5. Lost or Delayed Shipments
Once an order is shipped, the customer receives (if applicable) a tracking number by email.
GooL is not responsible for delivery delays or losses caused by postal services or customs.
However, we will assist you in any claim process with the carrier.
6. Returns and Exchanges
Because each item is either handmade, printed to order, or part of a limited series, returns are handled carefully case by case.
Eligible items:
You may request a return or exchange for non-custom, non-subscription items (such as original artworks or fine art prints) within 14 days after delivery, in accordance with EU consumer law.
Returned items must be:

unused, undamaged, and in their original packaging;

shipped back at your expense to the address provided by GooL after your return request is accepted.
Refunds are issued within 14 days after receipt of the returned item.
Non-returnable items:
The following items are not eligible for return, exchange, or refund:

Digital files or downloads, once accessed or delivered.
Only non-customized, reproducible items such as standard art prints or fine art prints (non-personalized, in stock) are eligible for the 14-day withdrawal period.

We may request photos of the damage for verification.
Depending on the situation, you may receive a replacement, repair, or refund.
